Thailand Exempts Seven Service Categories From Foreign Business Act Permits

Thailand’s Commerce Minister signed a new ministerial regulation under the Foreign Business Act, published in the Royal Gazette, that lets seven specific kinds of service business operate without first obtaining a foreign business licence. The exempted activities are narrow and mostly involve companies serving their own corporate group: Type 1 telecom resale, treasury-centre operations, shared administrative/HR/IT services between related companies, renting small amounts of space for staff vending and payment machines, domestic debt guarantees between related firms, direct petroleum-drilling service contracts, and certain securities and derivatives activities. Businesses using the exemption still have to meet whatever licensing and oversight rules apply under the specific law governing that sector.

The ministry moved quickly to head off a misreading of the change, stating explicitly that it does not extend to hotels, restaurants or tour operations, which still require a foreign business licence as before. For anyone running or investing in a foreign-owned company in Thailand, the practical effect is that a handful of internal group-services setups no longer need a separate FBA application, while the core restrictions on most foreign-owned service businesses are unchanged.
